TERMS OF SERVICE FOR TUTORING
OVERVIEW
This website is operated by Brocklehurst Academy. Throughout the site, the terms “we”, “us”, “our”, and "Brocklehurst Academy" refer to Brocklehurst Academy. Brocklehurst Academy offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current website shall also be subject to the Terms of Service. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
SECTION 1 - Billing

Brocklehurst Academy provides parents and students with a transparent, automated billing system. Credit or debit card details are stored on a secure payment platform. All lesson records, invoices, and payment records are available on your account. All credit or debit card details are securely encrypted, kept confidential, and deleted from our system once tutoring has ceased.
For PAYG (Pay As You Go), credit or debit cards are automatically billed each fortnight, according to the Brocklehurst Academy billing cycle. Payments are typically processed every second Monday and cover all lessons that took place in the previous 14 days. Occasionally, the payment processing day may change (e.g., if the Monday falls on a public holiday). However, the fortnightly billing cycle itself remains consistent, running from Monday (day 1) through to the following Sunday (day 14).

Example billing cycle:

The billing cycle runs from Monday 1st to Sunday 14th.

Monday 15th is billing day.

On Monday 15th, you are billed for all lessons that occurred during the previous 14 days (Monday 1st to Sunday 14th).

For Prepaid 10-Hour Packages, an invoice will be emailed each time a package is issued, and payment will be automatically charged to your credit or debit card three days later. Prepaid 10-Hour Packages are automatically renewed when unused credit drops below two hours.​
SECTION 2 - Weekly Tutoring, Lesson Rescheduling, and Cancellations

Brocklehurst Academy specialises in regular, weekly tutoring. Students who commit to consistent lessons benefit the most from our highly skilled team. While occasional rescheduling or cancellations are acceptable, students who demonstrate a lack of commitment may be withdrawn from tutoring to make space for students on our waiting list who desire regular lessons.
Students failing to attend weekly lessons without contacting us at info@brocklehurstacademy.com to obtain approval or provide termination notice may be charged a termination fee equivalent to one PAYG hour if more than 21 days have elapsed since the last lesson.

Rescheduling or cancellation of a session requires direct communication with the tutor at least 24 hours prior to the scheduled session. Charges will apply for rescheduling or cancelling a session with less than 24 hours' notice.

SECTION 3 - Termination of Tutoring

SECTION 4 - Contracts
Brocklehurst Academy does not require lock-in contracts. If you are not 100% satisfied, tutoring can be ceased at any time. Requests to change tutors for any reason can also be accommodated. For assistance, contact info@brocklehurstacademy.com.

SECTION 5 - Switching Billing Options
Billing options can be switched at any time by contacting info@brocklehurstacademy.com.

PAYG (Pay As You Go): Flexible, no lock-in contracts. Payments are made fortnightly after lessons are conducted.

Prepaid 10-Hour Package: You have the option of prepaying for 10 hours of tutoring. This option is ideal for students seeking a long-term commitment.
SECTION 6 - Online Classes
Class Times
Termly classes align with the New South Wales (Australia) school terms. Class times are fixed and agreed upon before the term begins. Each term consists of ten lessons, each lasting two hours, with a five-minute break midway through.
Teaching Staff
The designated class teacher will be arranged prior to the start of the term and will teach all ten lessons. In rare circumstances, such as illness, Brocklehurst Academy reserves the right to substitute the teacher.
Lesson Format
Lessons are conducted via Zoom and Google Docs. Each student receives an individual Google Doc with learning materials before the lesson. Students are required to:

Keep their camera operational throughout the lesson to ensure active participation.

Use the 'hand up' function to request permission to speak, as interruptions are not permitted.
Lessons are automatically recorded and made available to absent students. Recordings are deleted after 30 days.

Homework Requirements
Homework is assigned at the end of each lesson and typically requires 30 minutes to one hour to complete. Homework must be completed in the student’s designated Google Doc and submitted 48 hours prior to the next lesson. Teachers will provide detailed feedback, which students are expected to review and apply.

Required Equipment
Students must have:

A laptop or tablet compatible with Zoom and Google Docs.

A Zoom account.

A Gmail address to access Google Docs.

If located in China, a working VPN to access Google services.

Absences
Lessons cannot be rescheduled or cancelled once the term has commenced. If a student is absent, they will receive a recording of the lesson and are expected to complete the classwork and homework independently. Homework feedback will be provided as usual.

Fees and Payment
Each online lesson costs $100 ($50 per hour). Bulk payment for 10 lessons ($1,000) must be made before the first lesson of the term. Missed lessons cannot be credited toward future lessons, and no refunds will be issued for missed lessons or after the term has begun.

Trial Option
New students may opt for a trial of two lessons for $200. Payment must be received before the first lesson. After the trial, students may choose whether to continue for the remainder of the term.
