Terms & Conditions for Tutoring
Overview
This website is operated by Brocklehurst Academy Pty Ltd (ABN: 75 686 164 527). Throughout the site, the terms “we”, “us”, “our”, and “Brocklehurst Academy” refer to Brocklehurst Academy Pty Ltd.
By accessing our website and/or engaging our tutoring services, you agree to be bound by the following Terms and Conditions (“Terms”), including any additional terms referenced herein. These Terms apply to all users, including parents/guardians, students, and clients.
By submitting payment for any Brocklehurst Academy service, you confirm that you have read, understood, and agreed to these Terms. Payment constitutes acceptance of these Terms and Conditions. If you do not agree to these Terms, you must not use our services.
We reserve the right to update or amend these Terms at any time. Updated Terms will be published on our website. Continued use of our services, or submission of payment after updated Terms are published, constitutes acceptance of the updated Terms.
1. What You Can Expect from Brocklehurst Academy
Brocklehurst Academy provides high-quality, academically rigorous tutoring delivered by highly qualified educators. Clients can expect:

Punctuality and preparation for all lessons

Clear, structured explanations suited to the student’s level

Professional and respectful conduct at all times
-
Individualised instruction tailored to each student
-
Engaging and supportive lessons designed to build confidence
-
Access to resources via a shared Google Drive folder
-
Session notes recorded in the Tutorbird portal
-
Academic integrity, with tutors guiding students rather than completing work on their behalf
1a. Academic Improvement
While we aim to support meaningful academic growth, Brocklehurst Academy does not guarantee immediate grade improvements. Progress depends on sustained effort, engagement, and time.
1b. Marking and Feedback Outside Lesson Time
Private tutors are not expected to mark work outside scheduled lesson hours. Any marking outside lesson time is:

At the tutor’s discretion

Billed at the tutor’s standard hourly rate
For online group classes, weekly homework is marked provided it is submitted at least 48 hours before the next lesson.
1c. Your Tutor

Private tuition students will normally retain the same tutor throughout the engagement.

Tutor changes may be requested at any time.

Group class tutors are allocated before the term begins.

Substitute tutors may be used in cases of illness or emergency; no refunds apply in these cases.
2. What We Expect from Our Students
Students are expected to:

Arrive on time and prepared

Commit to weekly lessons during NSW school terms
-
Maintain a quiet, distraction-free learning environment (online)
-
Have access to Google Drive materials (VPN required where applicable)

Complete homework and independent study
-
Maintain a regular independent reading habit
-
Participate actively and respectfully
-
Uphold academic integrity, including transparency regarding AI use
3. Brocklehurst Academy Portal (Tutorbird)
We use Tutorbird to manage scheduling, records, and invoicing. Clients can:

View lesson history and upcoming sessions
-
Access tutor notes
-
View and manage invoices
-
Request rescheduling (subject to policy below)
4. Lesson Commitment
By enrolling, you are reserving a fixed weekly time slot that cannot be offered to another student. Fees are charged for the reserved time, not attendance.
We only accept students who commit to weekly lessons during NSW school terms:

We do not offer discounts. Fees are set to reflect the expertise of our tutors, the preparation involved, and the reservation of a dedicated weekly time slot.
5. Fees and Payment Structure (Effective 2026)
A. Online Group Classes (Years 7–9)

$110 per two-hour lesson

$1,100 per 10-week term (payable upfront)
Trial option:

$220 for two lessons
-
No obligation to continue beyond the trial
B. Scholars’ Programme (Years 7–9)
Includes:
-
One 2-hour group class per week
-
One 1-hour private lesson per week (Gold tutor)
-
$2,100 per 10-week term (payable upfront)
Trial option:
-
$420 for two weeks
-
No obligation to continue beyond the trial
C. One-on-One (Private) Tuition
Private tuition is offered by bulk payment only.

Clients must prepay for 10 lessons upfront
-
Lessons may be 60, 90, or 120 minutes
Indicative rates (per hour):

Gold Tutor (Years 7–10): $120
-
Gold Tutor (Years 11–12): $130
-
Platinum Tutor (Years 7–10): $150
-
Platinum Tutor (Years 11–12): $160
6. Rescheduling, Cancellations, and No-Shows (Private Tuition)
This section applies to one-on-one (private) tuition. Separate provisions apply to online group classes and the Scholars’ Programme.
6.1 Weekly Lesson Commitment
By enrolling in private tuition, clients acknowledge that:

Lessons are booked on a weekly basis during NSW school terms;
-
A fixed weekly time slot is reserved exclusively for the student;
-
Fees are charged for the reservation of this time slot, not attendance alone. This time cannot be offered to another student at short notice.
6.2 Notice Requirement
-
A minimum of 24 hours’ notice is required to cancel or reschedule a lesson without charge.
-
Notice must be given via the Tutorbird portal and/or direct communication with the tutor (email, text, or phone).
-
Cancellations made with less than 24 hours’ notice are normally charged in full.
Where a lesson is cancelled with sufficient notice, students are expected to reschedule within the same or following week, subject to tutor availability, in order to maintain weekly continuity.
If a cancelled lesson cannot be rescheduled for a time in the same week, a lesson credit of equivalent value to one standard private lesson will be issued, to be applied in accordance with the credit policy below.
Credits issued for private tuition cancellations:

Are not refundable as cash;
-
May only be applied toward payment for the following term’s private tuition;
-
Are limited to a maximum of two (2) credits carried forward per student. Any credits in excess of this limit will be forfeited.
6.3 Late Cancellations (Less Than 24 Hours’ Notice)
Cancellations made with less than 24 hours’ notice are charged in full, except in the limited circumstances set out below.
As a gesture of goodwill, Brocklehurst Academy may waive the fee for a first late cancellation. This is a one-time courtesy only and does not apply to repeated late cancellations.
6.4 Acceptable Reasons for Late Cancellation
The following reasons will generally be considered valid, provided the student or parent/guardian contacts the tutor before the scheduled lesson start time:

Serious accidents or injuries
-
Sudden or traumatic events (e.g. bereavement)
-
Genuine emergencies or catastrophes
-
Unexpected transport disruptions (e.g. train breakdowns)
-
Sudden illness that begins within the 24 hours prior to the lesson
Where a cancellation is accepted on these grounds, the lesson will not be charged and may be credited in accordance with our credit policy.
6.5 Unacceptable Reasons for Late Cancellation
After any one-time courtesy waiver, the following reasons will not normally be accepted, and the lesson will be charged in full:

Last-minute exam preparation or schoolwork in another subject

Scheduling conflicts or diary mismanagement
-
Overlapping school events that were known in advance
-
Forgetting the lesson
-
Confusion about lesson times
Clients are responsible for managing their schedules and providing timely notice.
6.6 No-Shows
A no-show occurs when a student fails to attend a scheduled lesson and does not provide notice before the lesson start time.

Tutors will wait up to 15 minutes from the scheduled start time and attempt to make contact.
-
If no contact is made, the lesson will be marked Absent, Billable and charged in full.
As a gesture of goodwill, Brocklehurst Academy may waive the fee for a first no-show. Any subsequent no-shows will be charged unless a valid reason applies.
6.7 Acceptable Reasons for a No-Show
The following may be accepted as valid reasons:

Sudden traumatic events (e.g. bereavement)

Genuine emergencies or catastrophes
6.8 Unacceptable Reasons for a No-Show
The following will not normally be accepted:
-
Illness where no attempt was made to notify the tutor prior to the lesson

Transport delays where no contact was made before the lesson
-
Forgetting the lesson
-
Confusion about times
-
School events or other commitments
6.9 Discretion
While the above lists provide guidance, Brocklehurst Academy reserves the right to exercise reasonable discretion in assessing individual circumstances, balancing compassion with the need to maintain a fair and reliable timetable for all students.
6.10 Scholar's Programme (Private Tuition Component)
The Scholar’s Programme includes a weekly one-on-one private lesson, which is subject to the following additional conditions:

Where a private Scholar’s Programme lesson is cancelled with at least 24 hours’ notice and rescheduled within the same week, no credit is issued.

Where a private Scholar’s Programme lesson is cancelled with valid notice but cannot be rescheduled within the same week, the client will be issued a $100 credit.

Credits:
-
Are not refundable as cash;
-
May only be applied toward payment for the following term;
-
Are limited to a maximum of two (2) credits carried forward per student.

7. Non-Payment
If payment has not been made for any previous or upcoming lessons, the next scheduled lesson will not proceed until payment is received.
8. Payment Methods & Fees

All services must be paid upfront in accordance with the structures above

A 0.5% surcharge applies to all debit/credit card payments

No surcharge applies to bank transfer payments

9. Termination of Services

Clients may discontinue services at the end of a prepaid period

No refunds are provided for unused lessons except where required by Australian Consumer Law or explicitly stated in writing

Trial payments are non-refundable
10. Consumer Law Notice
Nothing in these Terms excludes, restricts, or modifies any consumer rights available under the Australian Consumer Law (ACL).
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
By engaging Brocklehurst Academy services, you confirm your acceptance of these Terms and Conditions.
